Refers to Texas Penal Code 21.06, which reads: "Sec. 21.06. HOMOSEXUAL CONDUCT. (a) A person commits an offense if he engages in deviate sexual intercourse with another individual of the same sex."

The code was invalidated with Lawrence v. Texas, a landmark decision by the United States Supreme Court. The Court struck down the sodomy law in Texas and, by extension, invalidated sodomy laws in 13 other states, making same-sex sexual activity legal in every U.S. state and territory.
